TERMS AND CONDITIONS 1. The Primary GUEST booking through the booking platform (e.g., Airbnb) website agrees to be the responsible party, and hereunto shall be referred to as PRIMARY GUEST. Myself, the owner, (“Janine”) shall hereunto be referred to as OWNER. We are super excited to host you at Kookaburra Cabin and we kindly ask that you read the rules below to ensure a positive experience for everyone. Please respect our home and treat it as your own as we have put a lot of love and hard work into this house! We want you to ensure you have the best time with us and consider us for future stays.
The Primary Guest will be required to sign a Rental Agreement and Big Bear's Good Neighbor Policy, which outlines the city's rules for short term rentals, provide full names, ages and relationship to Primary Guest of all guests, and upload a copy of Primary Guests Government ID/Drivers License within 24 hours of a link being sent to the Primary Guest. Failure to sign these documents and provide ID prior to check in will result in the cancellation of GUEST’s reservation; cancelation policy will apply.
AGE REQUIREMENT - Primary Guest must be 25 years of age or older. Primary Guest is defined as the person reserving and paying for the security deposit/rental fees and is responsible for all guests staying at the property during their stay.
CHECK IN: Check in instructions, including a code to the keypad located on the front door, WIFI information and other helpful information, will be provided within 48 hours prior to your arrival. Check-in is 4:00PM, checkout is 11:00AM. For early check-in/late-check-out, please obtain prior approval from Owner. If Guest fails to check out by 11:00 AM (or other agreed upon time), Guest agrees to pay $100 per hour, each hour that Guest overstays. After 3 hours of an additional overstay, Guest agrees to pay for an additional nightly rate for those specific dates.
MAXIMUM OCCUPANCY: The maximum occupancy including all adults, children and infants is 8. For guests that violate our maximum permitted occupancy of 8 guests, a fee of $500.00 per person per night will apply. Guest also understands possible eviction and fines by City of Big Bear Lake/San Bernardino County may be issued to the Guest. If the Owner is issued a fine (or fines) due to over-occupancy or any violation of other county ordinances, Guest agrees to pay any and all fines issued to the Owner by San Bernardino County, City of Big Bear Lake and/or the Sheriff's Department.
PROPERTY CHECK: You and your guests are financially responsible for any damage done to the home during your stay. If you notice any damage or anything out of the ordinary, please contact the Owner within 1 hour of your arrival. Please make sure to check to see if you have heat, electricity, hot water and the hot tub is working upon arrival.
SECURITY CAMERAS We have 3 outdoor security cameras + floodlights located in front of the driveway, side of the house near the deck and side of the house near the front door as well as 1 Ring Doorbell camera. We respect our Guests privacy. Cameras are not for the purpose of monitoring our guests, but for security purposes.
CLEANING: The property will be cleaned and inspected before guest’s arrival and after guest’s departure. Guests may purchase additional cleaning at guests own expense. If any damages are found at the home upon your arrival they must be reported to Owner. If you fail to do so you will be responsible for the cost of the damage.
UNREGISTERED VISITORS: Unregistered guests/visitors are not permitted in the house or on the property grounds at any time. Fine of $500.00 per unregistered visitor/guest.
QUIET HOURS: Please understand that you are a guest of Big Bear Lake and staying in a residential area. Quiet hours are from 10:00 PM to 7:00 AM per City Ordinance. Guests should avoid making excessive noise of any type, at any time, and should consider the welfare of other residents and guests at all times. A fine of $500.00 will be issued by the city for any excessive noise anywhere in or around the Property after 10:00pm.
WE ARE A SMOKE FREE PROPERTY: Big Bear is a high fire risk community. Smoking/Vaping/Drugs is prohibited anywhere within or around the house, including the decks, backyard and driveway. Failure to comply with result in a $500.00 fee.
NO PETS: For allergy/health reasons, animals are not permitted. Should Guest not abide by this rule, Guest agrees to pay a fee of $500.00 per animal per day or night. Guest also agrees to pay any additional cleaning fees required to fully remove feces, urine, dirt/mud, fur, dander etc. from inside the Property and surrounding Property grounds due to the presence of animals.
NO PARTIES: Parties of any kind (weddings, corporate events, bachelor/ bachelorette parties, house parties, etc.) are STRICTLY PROHIBITED. No Amplified music (noise/speaker) loud enough to be heard past the property line. We have year-round neighbors on our street that will not tolerate such activities and will report these events immediately. Fine of $500.00 if you do no adhere.
PARKING: THE MAXIMUM NUMBER OF VEHICLES IS 3. Vehicles must be parked in the driveway ONLY. Excessive vehicles or improper parking which includes parking on the street or your vehicle sticking out past the driveway line is prohibited and will warrant a fine of $500.00.
NO TRASH LEFT ON PROPERTY: TRASH or REFUSE CANNOT BE LEFT OR STORED ON THE PROPERTY AFTER YOUR STAY. Big Bear Lake does not provide trash removal for vacation rentals. Therefore, you must remove all of your trash. During and/or on the day of your check out, please take all the trash you accumulated during your stay to one of the nearest Clean Bear locations. If you do not adhere to this, you will be charged $25 per bag of trash left in the fridge, in kitchen or anywhere onsite.

BACKYARD LIGHTS: Must be turned off by 10:00pm every night. Having lights on in the backyard after 10:00pm is a City violation and will incur a fine.
NO CANDLES: No candles permitted anywhere on the Property due to fire hazard.
POWER OUTAGES: The Big Bear Valley and the surrounding San Bernardino Mountains are subject to temporary power outages due to weather/natural events. GUEST hereby understands and accepts these risks as part of visiting the area and the home.
FIREPLACE IS GAS ONLY: Wood burning fires are strictly prohibited anywhere at the Property. The fireplace in the living room is gas only, which requires just turning the gas on and igniting the logs, and is already equipped with gas logs. Fireplace will only to be used as ambiance and not a source of heat. Under no circumstances will Guests add or replace Owners gas logs with wood burning logs. Guest will only use the fireplace while they are inside the house and turn off fireplace before leaving premises at any time. $500 fee if gas logs are removed and replaced with wood burning logs.
PROPANE TANKS: Propane tanks are provided for Guests use for the BBQ grill and dining table on the deck and the firepit in the backyard. Propane tanks are filled as needed or when reported empty by guests. Extra tanks are stored in the enclosed storage container on the front porch, next to the front door. If you find the propane tank runs out during your stay, please call us and we will dispatch a person with a replacement. In case of delays, tenants are welcome to exchange the propane tanks out themselves if they wish. Walgreen’s, DIY and others provide an exchange program. We will offer a credit if you do an exchange and provide us a receipt, saving a lot of possible time. Please store empty propane tanks back in the enclosed storage container near the front door.
COMMERCIAL PURPOSES: The use of our Property for commercial purposes is strictly prohibited without expressed written consent from the Owner. Commercial purposes include, but are not limited to: photography, videography, and/or cinematography to advance a person’s or company’s commercial or economic interests, such as by inducing another person to buy, rent, lease, join, subscribe to, provide, or exchange products, goods, property, information, or services, or enabling or effecting, directly or indirectly, a commercial transaction. Guest agrees to inquire with the Owner prior to creation of the aforementioned commercial content; please note a separate contract, additional fees, insurance, and County issued permits are required. Violation of this COMMERCIAL PURPOSES clause will result in a minimum fee of $10,000.00.
FIREWORKS: Fireworks are always prohibited on the San Bernardino National Forest. The US Forest Service will be aggressively citing those who do not comply with the posted restrictions. Violation of these prohibitions is subject to punishment by a fine of not more than $10,000 or imprisonment for not more than six months or both, as Class B misdemeanors under federal law. Persons may also be responsible for resource damage, suppression costs and any injuries that occur if they are found liable for causing a wildfire.
SNOW REMOVAL: We provide a snow removal service for our driveway and stairs when snow reaches 3 inches or higher. However, local snow removal companies cannot guarantee a specific time the property will be serviced. City snow plows are dispatched only after 4-6 inches of accumulation has occurred and removal is also based on city and snow removal company’s schedules and routes. City plows may inadvertently leave a berm or small snow bank across the driveway which may impede access to the house. Therefore, Guest may have to shovel a spot in order to park if GUEST arrives early (prior to professional removal) or if it snows during Guest’s stay. A shovel is provided for guests use. Issues or delays may arise if snow fall occurs close to your arrival or check-in, so please watch the weather to be prepared. Guests are responsible for time and cost of snow removal during their stay and no credits will be issued due to inconvenience or issues. Snow is a desired mountain seasonal climate occurrence during the winter months. Winter snow will likely reduce parking by one (1) or more spaces depending on your location. Plan appropriately. Decks, porches, BBQ’s and/or hot tubs may be snowed in depending on how much snow any given storm produces. Shoveling may be required to gain access to the cabin. Guests understand that the homeowners, employees and managers (collectively, the “Released Parties”) are NOT responsible for any injury caused by slipping on snow or ice and that the Guests are responsible for the removal of snow and ice around the doorways and paths to house and car; that the Released Parties are not responsible for any personal injury or loss or damage to the Guests.
TIRE CHAINS: You are required to carry tire chains in your vehicle when traveling in mountain communities in the state of California from November through April. We are not able to help if your car becomes stuck for liability reasons.
EVENTS OUT OF OUR CONTROL: No refunds will be given and Guests assume the risk to their persons and property caused directly or indirectly from foul, inclement weather conditions, acts of nature, failure of heat, accidents related to fire, heaters, stoves, or hot tubs, traffic/travel delays, road or highway closures, poor air quality, power outages, the requirement of chains, and/or the closure of the surrounding National Forest(s), Owners’ failure to remove snow and ice around access areas or for any unforeseeable circumstances. Under no circumstances will the Guests or their guests hold the Released Parties responsible for any damages or claims of any kind resulting from their stay. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. If all three access roads to and from Big Bear are closed for more than four hours at the same time, then you may re-schedule your stay for another time in the same home, you will have to pay the price difference if the price is higher.
HAMMOCK: The backyard is equipped with a hammock that can hold two people at a weight of no more than 450lbs combined. Guest is allowed to use the hammock at their own discretion and understand it is their sole responsibility and decision if chosen to be used. Guest agrees to not hold the Owner or Management responsible for any harm or injury caused by the use of the hammock.
HOT TUB: The hot tub has been serviced prior to your arrival. During summer months, the temperature may be lowered to 80 to conserve energy. Please preheat the hot tub to your desired temperature before you enter (we recommend 100°F). During winter months, the temperature should remain at 100°F to prevent freezing and conserve energy. Do not lower the temperature. To remove the cover, remove all (4) straps from the hooks. Open the cover and slide it off onto the concrete behind the hot tub. Please be sure to put the cover back on and secure straps when not in use. The use of an outdoor spa or any other activity that disturbs the peace is prohibited between the hours of 10:00 p.m. and 8:00 a.m. (per Big Bear Lake Ordinance No. 2021-488). Children under the age of fourteen (14) years must be accompanied by a responsible adult in the hot tub. Infants and toddlers are not recommended to is the hot tub, but if they do, they need to wear “swim diapers. No person with open wounds or known to be afflicted with an infectious disease or suffering from flu like symptoms may use the hot tub. A $65.00 minimum charge for a dirty hot tub requiring draining, cleaning and refill due to Guests negligence. Cost shall be determined by the Owner’s professional Spa Service and will be based on the amount of time required to return the Hot Tub to the state it was in at time it was received by Guest. There may be additional charges for filters if needed. Guest agrees to never use soaps, shampoos, bubble bath or any product that creates suds as this can damage the hot tub. Guest is aware that the chemical balance of a hot tub is measured and can change due to alcohol, urine, feces, lotions, etc and can easily trigger the necessity for a drain, refill and scrub which will be charged to the Guest. Guest will adhere to all other “Spa Rules” posted near the hot tub.
POKER/BUMPER POOL TABLE: Poker table upstairs in the loft is also a bumper pool table. Guests will take extra care when removing the poker table in order to play bumper pool. Damage to the table will be charged to the Guest. Bumper pool sticks and balls are located in the shuffle board draw.
GAMES: We have provided a lot of games for our Guest’s pleasure. Scrabble coffee table, checkers, chess, bumper pool, shuffle board etc. Guests are responsible for making sure all games are played with care and put back to their original form once finished. Any games with little pieces like scrabble, chess and checkers are not to be misplaced/lost and put away as they were found, otherwise there will be a cost to the Guest to replace any lost or misplaced items. Guests will be extra careful when removing the scrabble/coffee table glass in order to play scrabble. Any damage to the glass or to the table will incur a $400 charge to the Guest for replacement cost. Scrabble pieces are located in the living room TV cabinet.
WASHING MACHINE & DRYER: The Property is equipped with a washing machine and dryer for our Guest’s convenience. Please adhere to the instructions posted in the utility room. Owner is not responsible for damaged articles.
THERMOSTAT: Do not set the thermostat lower than 55 degrees from October 1st - May 1st. This may result in the pipes freezing and bursting. During summer months no need to adjust thermostat.
MAINTENANCE. The Guest shall maintain the premises in a good, clean, and ready to rent condition, and use the Property only in a careful and lawful manner. The Guest shall leave the Property in a ready to rent condition at the expiration of the rental agreement, and agree to be liable for additional charges resulting from damage to Property and/or furnishings, lost items, or excessive check out cleaning.
ENTRY. The Owner or its Representatives shall have the right at all reasonable times during the term of this Agreement and any renewal thereof to enter the Property for the purpose of any repair, modification, alteration, installation, scheduled pest control spraying or other reasonable action, so long they provide at least twenty-four (24) hours’ notice to the Guest unless it is considered an emergency.
LIABILITY: Guest, Rental Party and all invitees assumes all risk and liability by entering the Property and surrounding property grounds and by booking Guest agrees to the release of liability waiver outlined directly below: RELEASE OF LIABILITY WAIVER FORM/STATEMENT: Guest, Rental Party and all invitees understands that the Owner is not responsible for any injury, illness, or death and under no circumstances will the Guest, Rental Party and all invitees hold the Owner responsible for any damages or claims of any kind resulting from their stay at the Property. Guest, Rental Party and all invitees additionally hereby acknowledges the Owner is not responsible for any injury or death caused by slipping on snow or ice and that the Guest, Rental Party and all invitees are responsible for the removal of any residual snow and ice around the doorways and paths to the Property and/or parking areas. Guest, Rental Party and all invitees hereby expressly, knowingly and freely assume all liability (or risk of liability) of any kind, for any injury, illness, or death (including due to COVID-19) of persons and/or damage to property of guest or any other person, from any cause whatsoever, foreseeable, or unforeseeable, resulting from the use, occupancy, or enjoyment of the Property by the Guest, Rental Party and all invitees, or any person residing at the Property, or persons acting on their behalf, and Guest, Rental Party and all invitees hereby releases and discharges the Owner from all liability, claims, demands, losses, or damages caused or alleged to be caused in whole or in part by the negligence of Owner or otherwise.
OWNER CANCELLATION: Owner reserves the right to cancel this reservation at any time. If the Owner cancels this reservation prior to the start of the reservation, a full refund will be provided to the Guest. If the Owner cancels this reservation, following the arrival of Guest to the Property, because Guest has violated any portion or portions of this Agreement between Owner and Guest, no refund shall be provided.
POSSESSION & SURRENDER. Guest shall be entitled to possession of the Property at 4:00pm on the 1st day of the Rental Term. On the last day of the Rental Term at 11:00am, Guest shall peaceably surrender the Premises to the Owner in good condition, as it was at the commencement of the Agreement.
ATTORNEY’S FEES. Guest agrees to pay for all reasonable costs, attorney’s fees, and expenses that result from the Owner enforcing this Agreement.
REFUNDS. The Guest shall not receive a refund due to a shortened stay and/or poor experience that resulted from unfavorable weather conditions.
VIOLATION FEES: Failure to follow the terms of this Agreement, comply with the “House Rules”, and/or complete all check-out requirements (sent by Owner to Guest), may result in additional fees. Applicable fees include, but are not limited to:
